5/96 Amendemmet to Covenants and Restrictions STATE OF SOUTH CAROLINAAMENDMENTS TO DECLARATIONS OF COVENANTS AND RESTRICTIONS FOR COUNTY OF YORK BAILIWYCK COMMUNITY, YORK COUNTY, SOUTH CAROLINA AND PROVISIONS OF BAILIWYCK COMMUNITY HOMEOWNERS ASSOCIATION, INC. WHEREAS, Pleasant Road Development Company, Inc., being the owner of a certain real property development in York County, South Carolina, known as the Bailiwyck Community, placed on the record certain Declarations of Covenants and Restrictions and Provisions for a Homeowners Association by instrument dated February 20, 1987, and recorded in the Office of the Clerk of Court for York County on February 25, 1987 in Book 937 at Page 113, and Amendments thereto recorded on June 13, 1994 in Book 1028 at Page 205 and January 20, 1995 in Book 1176 at Page 109, WHEREAS, the Homeowners Association, pursuant to Article VII, Section 1 of the aforementioned Restrictions and Provisions may amend same, at any time, by a vote of three-fourths (3/4) of its membership at a duly called meeting of the Association, and WHEREAS, the Association at a duly called meeting, at which a quorum was present, adopted certain changes and amendments to these Restrictions and Covenants, NOW THEREFORE, the aforementioned Declarations of Restrictions and Covenants and Provisions of Bailiwyck Community Homeowners Association, Inc. are amended as follows: 1. By replacing the existing Article VII, Section 4 with the following:Section 4. Review and Approval of Initial Building and Landscaping Specifications; Review and Approval of Landscaping Specifications for Additions, Alterations or Changes to Structures; Enforcement. No building, wall, fence, swimming pool, or other structure shall be commenced, erected or maintained upon the Common Properties or within the subdivision, until the plans and specifications therefore showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing as to the harmony and compatibility of its external design and location, with the surrounding structures and topography, by Bailiwyck Architectural Review Committee and its duly appointed agents. Following the initial construction, as approved by Bailiwyck Architectural Review Committee, any exterior additions to any existing structure or change or alteration thereto including the construction of walls, fences, swimming pools or other structures shall require the prior written approval of the Bailiwyck Homeowners Association. The Bailiwyck Homeowners Association's Board of Directors shall have the right to constitute and appoint an architectural review committee for the purpose of reviewing requests for alterations or additions which occur after initial construction. The Architectural Review Committee, for purposes of initial construction, and the Bailiwyck Homeowners Association, for purposes of additions or alterations after initial construction, shall be entitled to enforce the within covenants by making petition to the Circuit Court for all necessary relief, including temporary or permanent injunction. The Architectural Review Committee and the Bailiwyck Homeowners Association shall be entitled to reimbursement for any and all costs incurred including legal costs and attorneys fees in pursuing said enforcement. The aforementioned represents the amendments and modification to the original Declaration of Covenants and Restrictions and Provisions of Bailiwyck Community Homeowners Association, Inc. attached hereto and incorporated herein and are reflected in a complete version of the Declarations indicating the amendments as found in their appropriate locations within the document as a whole. All other restrictions and covenants and provisions as contained in the original Declaration filed in Book 937 at Page 113 and the Amendments thereto filed in Book 1028 at Page 205 and Book 1176 at Page 109 shall remain in full force and effect as therein written.
