The Bailiwyck Community Homeowners Association, as owner of the Bailiwyck Community Clubhouse, establishes the following rules for use of the Clubhouse:
1. APPROVAL OF USE AND FUNCTION: The Homeowner's Association reserves the right to pre-approve any use and any functions to be held on the Clubhouse premises. The Homeowner's Association may establish a procedure for reserving the Clubhouse and will publish that procedure to the members of the Association. As part of the reservations procedure, the Association may require a minimum reservation period in order to allow the Association to approve the requested use and function. 2. PERMITTED USES OF THE CLUBHOUSE: Any member of the Homeowner's Association may reserve the Clubhouse for meetings, parties and other functions. Members may invite guests (non-members of the Association) to any approved function on the Clubhouse premises.The Clubhouse shall not be
used for any commercial or business purposes. Commercial or business use may be defined
as,
but not limited to; selling of products or services, soliciting prospective
customers or clients.
Members may provide alcoholic beverages at such functions, provided the member purchases and delivers the beverages to the premises and does not allow the consumption or possession of alcoholic beverages as prohibited below.
3. PROHIBITED USES OF THE CLUBHOUSE: Any member reserving and using the Clubhouse for a function shall not:A. Advertise the function to the general public.
B. Allow admission to an uninvited guest(s).
** C. Charge admission, sell tickets or request donations at functions where alcoholic beverages are served.
** D. Allow guest(s) to bring their own alcoholic beverages.
E. Allow the consumption or possession of alcoholic beverages by an individual under the age of 21 years.
F. Allow smoking inside the Clubhouse.
4. FEE FOR RESERVING AND USING THE CLUBHOUSE: The Association will charge a use fee of $100.00 for the usage of the clubhouse. This fee is required in advance, at the time the clubhouse is reserved, and will not be refundable, subject however, to the cancellation policy (item 8). The Clubhouse is not considered reserved until the fee is paid.5. CLEAN UP AFTER FUNCTION: Each member reserving and using the clubhouse shall be responsible for picking up and removing trash, washing dirty dishes, wiping tables, emptying trash cans, washing off kitchen countertops and cooking areas. All trash must be removed by renter immediately after rental (same day). Cleanup also includes the exterior of the Clubhouse and pool deck where guests may have left cups, bottles plates, etc. If a clubhouse committee member has to pick up trash or bag garbage, a portion of the damage deposit, determined by the committee, will be withheld. This fee will be at $25 or more depending on the size and nature of the mess. 6. DURATION: The Clubhouse shall be rented by the day, or part thereof. All setup and cleanup is to be done on the day of rental or additional rental fee will be due. 7. DAMAGES: Any member reserving the Clubhouse shall be responsible for any damage caused to the Clubhouse, its furniture, equipment, and fixtures including the carpet. If the charges to repair the damage exceed the amount of the deposit the renter will be held responsible for the balance and subsequently billed by the HOA. If a committee member has to clear a toilet there will be a $10 fee withheld from the damage deposit. A plunger is available for the renter to return a toilet to proper working order themselves and avoid paying the fee. If a plumber must be called to clear a sink or toilet the damage deposit will be withheld to cover the costs and the balance billed to the renter.In addition to the above fee, the Association will charge to each member reserving the Clubhouse a $150.00 loss or damage deposit. This deposit is to be paid prior to the function date and will be used for the purpose of the replacement or repairing of the Clubhouse facilities (including, but not limited to, all aspects of the interior, exterior, and grounds) as needed.
The sole exception to the require fees above are (1) Homeowners Association (HOA) annual, special, and general meetings, (2) Board and committee meeting of the HOA, and (3) functions sponsored by the Social Committee of the HOA.
Absolutely no nails or tacks are to be used to hang decorations. If they are, the renter will be held responsible for the total costs of having the holes repaired and the wall areas involved repainted.
Upon satisfactory inspection by the Clubhouse Committee, the member will be entitled to the return of the damage deposit.
8. CANCELLATION POLICY: Any member reserving the Clubhouse for a function shall have the right to cancel the reservation and receive a refund of the rental fee and the loss/damage deposit provided the member notifies the booking agent of the Clubhouse committee at least 30 days prior to the reserved date. Cancellation after this date will result in the forfeiture of the $100 rental fee. The damage deposit, however, will be returned. If the Clubhouse is able to be rented after a late cancellatiuon, the reservation fee will be refunded. Effective February 21, 2001** These items do not apply to functions sponsored by the Bailiwyck Community Homeowners Association where all members are invited to attend (i.e. Annual Homeowner's Meeting, Community Swimming pool party, Golf Tournament or any function sponsored by the Social Committee).
The Clubhouse shall not be used for
